Ever by X is an Australian-based fashion brand that owns and operates this website. The following terms and conditions apply to all visitors and users of the Ever by X website including all associated domains and subdomains but not limited to everbyx.com. By using this Website you agree to be bound by all subsequent rules and regulations.

In the event of a violation of these terms and conditions, Ever by X, ABN: 64151530344, reserves the right to seek all remedies available by law and in equity.

1.     Placing an Order and Payment
By placing an online order, you are offering to purchase a product at the listed price. Payment is required at checkout and can be made via Visa, MasterCard, Amex, Afterpay or PayPal. You confirm you are authorised to use the selected payment method. All orders are subject to confirmation by Ever by X. You will receive an email confirming receipt. We may reject any order and refund payment before dispatch. Orders must be paid in full at checkout. Transactions are processed in the currency displayed at checkout, based on your location or selected region. Your bank or card issuer may apply a currency conversion fee. Prices may change without notice. If increased pricing is requested, you may cancel within 7 business days of being notified.

2.     International Taxes and Refunds
Duty and tax handling varies by region. US and UK: Your order includes duty and tax, which we prepay to prioritise customs clearance and delivery within 4 to 7 days.
Worldwide: As our products are Australian Made, they are tax free for most regions. For Canada, Japan, UAE, and the EU, taxes vary and are charged on delivery. In case of returns, duties and taxes already paid to Customs cannot be refunded by Ever by X. Customers may apply to their local authority for reimbursement where applicable.

3.     Shipping and Delivery
AU: Free Australia Post delivery is included with all orders, or you can select Express to receive next day. US and UK: DHL manages priority customs clearance, delivering direct to you within 4 to 7 days with no more to pay. Worldwide: Customers can choose Standard, Express, or Courier services, with estimated delivery between 4 to 12 days depending on the option selected. Orders are dispatched from Sydney, Australia, Monday to Friday excluding public holidays. Orders placed before 12pm AEST are shipped the same day. Estimated delivery times are provided at checkout but are subject to courier performance and customs clearance in your country. Risk of loss passes to you upon delivery to the shipping address provided. We are not liable for delays caused by customs, courier networks, weather events, or factors beyond our control.

4.     Return Policy
Full-price items may be returned under our Returns Policy. Perfectly Imperfect styles are final sale, no returns or exchanges.

5.     Faulty Product Returns
We aim to provide products of the highest standard and quality. If you believe you have received a faulty product, please contact us at  e: hello@everbyx.com as soon as possible. Please forward us clear photos of any damage, defect, or fault for preliminary assessment. If the product is confirmed to have a defect, we will replace it or refund the purchase price to your original payment method, at your request. If the product is found not to have a defect or deemed outside of warranty, we will return it to you. A product will not be deemed faulty if, in our reasonable opinion, it has become of unacceptable quality due to fair wear and tear such as creasing in transit, misuse, failure to follow care instructions, abnormal use, or failure to take reasonable care.

6.     100-Day Confidence Guarantee
Every order is covered by our 100-Day Confidence Guarantee. You have 100 days from receipt to enjoy, exchange, or refund items that must be completely unworn. To qualify for refund, items must be returned new, unworn, unwashed, scent-free, and free of marks, pilling, or pet hair; in the original packaging where possible. Our Style Masterclass and Style Concierge are available to help with sizing and styling advice at e: hello@everbyx.com Customers must provide order number, written confirmation that the item is unworn, and photos before a return label is issued. Once approved, we provide a prepaid return label flat rate US$50 internationally. The item must be lodged within 7 days of approval & sent to: Ever by X Returns, 40 Archbold Rd, Minchinbury NSW 2770 Australia. Upon receipt, quality control is completed within 24 hours. If the return passes inspection, we will process your requested exchange, store credit, or refund immediately. If minor wear is detected, for example light makeup or scent, Ever by X may offer to clean and recondition the item and issue store credit less a US$25 care fee.
If significant wear is found, for example pilling, hem scuffing, or seam stretching, the item will not be eligible for refund. Customers may elect for the item to be donated, recycled, or returned at courier cost. Delivery fees paid at purchase & pre-paid tariffs in US & UK are non-refundable. Customers are responsible for the safe return of goods. Nothing in this clause affects your rights under Australian Consumer Law. 

7.     Promotional Codes
Promo codes must be applied at checkout. If you forgot to enter a code, contact us straight after placing your order. Approval for a refund is at our discretion. One code per order. Unless stated, codes may only be used once per customer.

8.     Win Back Your Dress Promotion
Runs from 1 to 31 May 2025. To enter, place an order by 11:59pm AEST each Sunday. Every dress purchased equals one entry into that week’s draw. Bundle purchases equal multiple entries. One winner is drawn each Sunday, announced and refunded on Monday. Refund covers order value including discounts. Open worldwide to customers aged 18+, excluding Ever by X staff. Orders must be paid in full and not cancelled or returned. Ever by X may modify or cancel the promotion at any time. Decisions are final.

9.     Gift Cards
Ever by X gift cards are issued in the currency selected at purchase and can only be redeemed via our website. Gift cards are valid for 3 years from the date of purchase and cannot be exchanged for cash. Lost, stolen, or expired cards will not be replaced.
Purchases exceeding the available balance must be paid with another accepted payment method.

10.  Pre-Orders and Made-to-Order
Some items may be offered as pre-orders or made-to-order garments. Estimated delivery dates will be stated on the product page and may vary depending on production schedules. Payment is taken in full at the time of order to secure your garment.
Pre-orders cannot be cancelled once production has commenced. Standard Returns and Faulty Product policies apply once the item is delivered.

11.  Limitation of Promotions
Unless otherwise stated, promotional offers, discounts, and codes cannot be combined with other promotions or applied to previous purchases.

12.  Website Security
Everbyx.com uses SSL encryption for secure transactions. We do not store full credit card details, only the last four digits and expiry for verification. For unauthorised card use, please contact your card provider.

13.  Limitation of Liability
We strive to ensure site accuracy and secure transactions. However, we are not liable for any loss from third-party unauthorised access unless caused by our negligence. To the extent permitted by law, any liability is limited to product replacement, repair, or reimbursement.

14.  Intellectual Property
All Ever by X designs, prints, product names, images, videos, text, and other content on our website, packaging, and marketing channels are the exclusive property of Ever by X. No part of our designs, content, or imagery may be reproduced, distributed, copied, modified, or otherwise used for commercial purposes without prior written consent. Ever by X reserves the right to take legal action to protect its intellectual property rights.

15.  Website Availability
The website may occasionally experience downtime. Ever by X is not liable for interruptions but will aim to minimise them.

17.  Your Use of the Website
You agree to use this website lawfully and not to compromise its security or access unauthorised areas. We use cookies to personalise your experience. By using this site, you accept these terms. Terms may be updated at any time and changes will be published here.

18.  Termination
We may cancel any order before dispatch and refund your payment. We may also terminate your access to this site immediately if you breach these terms.

19.  Full Agreement
These Terms and our other site policies form the full agreement between Ever by X and you.

20.  Severability
If any term is deemed invalid or unenforceable, the remainder will remain in effect.

21.  Governing Law
These Terms are governed by the laws of New South Wales. Both parties submit to the jurisdiction of NSW courts.

22.  The Insiders Subscriber Signup and VIP Access
Subscribers receive VIP access to promotions and limited edition releases.
