Our Terms

Ever by X is an Australian-based luxury brand that owns and operates this website. The following terms and conditions apply to all visitors and users of the Ever by X website, including all associated domains and subdomains, including but not limited to everbyx.com. By using this website, you agree to be bound by all subsequent rules and regulations.

In the event of a violation of these terms and conditions, Ever by X, ABN: 64151530344, reserves the right to seek all remedies available by law and in equity.

1. Placing an Order and Payment
   By placing an online order, you are offering to purchase a product at the listed price. Payment is required at checkout and can be made via Visa, MasterCard, Amex, Afterpay, or PayPal. You confirm you are authorised to use the selected payment method. All orders are subject to confirmation by Ever by X. You will receive an email confirming receipt. We may reject any order and refund payment before dispatch. Orders must be paid in full at checkout. Transactions are processed in the currency displayed at checkout, based on your location or selected region. Your bank or card issuer may apply a currency conversion fee. Prices may change without notice. If increased pricing is requested, you may cancel within 7 business days of being notified.

2. Exchanges, Returns and Refunds
   Your order comes with our 100 Day Confidence Guarantee. We offer refunds on all full-priced items and exchanges on all sale items (which are final sale and not eligible for refund). We are here to help at every step, so if your purchase does not feel right, reach out early and our Stylist can guide you on fit and styling, or help you secure an exchange before we sell out. 3. International Tax
   We’re Australian Made, which means minimal import taxes worldwide. US: Your order includes minimal tariff that we pre-pay to US Customs when delivering into the US. On refund, we return the order price less local duty and handling of 20%. UK: Your order is tax free and includes local VAT that we prepay to HMRC. On refund, we return the order price less 20%. WW: We’re tax free for most. Local taxes are payable by the receiver in the EU, CA, JP and UAE.

4. Shipping and Delivery
   All orders received by midday AEST are despatched same day. AU: Free Australia Post delivery is included with all orders, or select Express for next day delivery. US and UK: Australia Post and FedEx manage priority customs, delivering direct within 3 to 7 days with no more to pay. Worldwide: Deliveries are sent via Australia Post Express, arriving within 4 to 7 days. Delivery times are provided as a guide. We are not liable for delays caused by customs and factors beyond our control.

5. Faulty Product Returns
   We aim to provide products of the highest standard and quality. If you believe you have received a faulty product, please email clear photographs to hello@everbyx.com as soon as possible and provide details of the defect.

6. 100-Day Confidence Guarantee
   Every order is covered by our 100-Day Confidence Guarantee. You have 100 days from receipt to enjoy, exchange, or refund items that are completely unworn. To qualify for a refund, items must be returned new, unworn, unwashed, scent-free, and free of marks, pilling, pet hair or signs of wear, in the original packaging where possible. Our Style Masterclass and Style Concierge are available to help with sizing and styling advice at hello@everbyx.com. Customers must provide an order number, written confirmation that the item is unworn, and photos. Once approved, customers may return the item using their preferred carrier at their own cost and must provide tracking. The returned item/s must be lodged within 7 days of approval and sent to: Ever by X Returns, c/o Williams Logistics Returns Dept, 69-73 Gow Street, Padstow NSW 2211. Upon receipt, quality control is completed within 24 hours. If the return passes inspection, we will process the requested exchange, store credit, or refund immediately. If minor wear is detected, for example light makeup or scent, Ever by X may offer to clean and recondition the item and issue store credit, less a US$25 care fee. If any wear is found, for example pilling, hem scuffing, or seam stretching, the item will not be eligible for refund. Customers may elect for the item to be donated, recycled, or returned at courier cost. Delivery fees paid at purchase and pre-paid tariffs in the US and UK are non-refundable. Customers are responsible for return shipping and the safe return of goods. Nothing in this clause affects your rights under Australian Consumer Law.

7. Promotional Codes
   Promo codes must be applied at checkout. If you forgot to enter a code, contact us straight after placing your order. Approval for a refund is at our discretion. One code per order. Unless stated, codes may only be used once per customer.

8. Gift Cards
   Ever by X gift cards are issued in the currency selected at purchase and can only be redeemed via our website. Gift cards are valid for 3 years from the date of purchase and cannot be exchanged for cash. Lost, stolen, or expired cards will not be replaced. Purchases exceeding the available balance must be paid with another accepted payment method.

9. Pre-Orders and Made-to-Order
   Some items may be offered as pre-orders or made-to-order garments. Estimated delivery dates will be stated on the product page and may vary depending on production schedules. Payment is taken in full at the time of order to secure your garment. Pre-orders cannot be cancelled once production has commenced. Standard Returns and Faulty Product policies apply once the item is delivered.

10. Limitation of Promotions
    Unless otherwise stated, promotional offers, discounts, and codes cannot be combined with other promotions or applied to previous purchases.

11. Website Security
    everbyx.com uses SSL encryption for secure transactions. We do not store full credit card details, only the last four digits and expiry for verification. For unauthorised card use, please contact your card provider.

12. Limitation of Liability
    We strive to ensure site accuracy and secure transactions. However, we are not liable for any loss from third-party unauthorised access unless caused by our negligence. To the extent permitted by law, any liability is limited to product replacement, repair, or reimbursement.

13. Intellectual Property
    All Ever by X designs, prints, product names, images, videos, text, and other content on our website, packaging, and marketing channels are the exclusive property of Ever by X. No part of our designs, content, or imagery may be reproduced, distributed, copied, modified, or otherwise used for commercial purposes without prior written consent. Ever by X reserves the right to take legal action to protect its intellectual property rights.

14. Website Availability
    The website may occasionally experience downtime. Ever by X is not liable for interruptions but will aim to minimise them.

16. Your Use of the Website
    You agree to use this website lawfully and not to compromise its security or access unauthorised areas. We use cookies to personalise your experience. By using this site, you accept these terms. These terms may be updated at any time, and changes will be published here.

17. Termination
    We may cancel any order before dispatch and refund your payment. We may also terminate your access to this site immediately if you breach these terms.

18. Full Agreement
    These Terms and our other site policies form the full agreement between Ever by X and you.

19. Severability
    If any term is deemed invalid or unenforceable, the remainder will remain in effect.

20. Governing Law
    These Terms are governed by the laws of New South Wales. Both parties submit to the jurisdiction of NSW courts.

21. The Insiders Subscriber Signup and VIP Access
    Subscribers receive VIP access to promotions and limited edition releases.
